These General Terms and Conditions apply to all services provided by Open Sky Cargo SRL ("Open Sky", "we", "us"), including ocean freight, air cargo, road freight coordination, local logistics and customs clearance. By engaging our services, the client accepts these terms in full.
Open Sky Cargo SRL is an independent Romanian company operating as an affiliate of Davidson International Group BV (Rotterdam, Netherlands) under a commercial agreement. For international road and land transport services, Open Sky Cargo SRL acts as local coordinator on behalf of Davidson International Group BV and does not independently provide road transport under its own licence. All road transport arrangements are coordinated through and executed under Davidson International Group BV.
Open Sky Cargo SRL provides the following services directly:
Road and land transport services are provided as coordinator for Davidson International Group BV only.
The client is responsible for providing accurate, complete and timely instructions and documentation. Open Sky Cargo SRL cannot be held liable for any loss, delay, costs or penalties arising from inaccurate or incomplete information provided by the client.
Carrier liability for loss or damage to goods in transit is strictly limited under applicable international conventions (AWB, Bill of Lading, CMR). Open Sky Cargo SRL strongly recommends that clients arrange adequate cargo insurance through their own broker. Unless expressly requested in writing and confirmed by us, no insurance is arranged on the client's behalf.
Customs clearance is carried out based on information provided by the client. The client warrants the accuracy of all declarations, values, classifications and supporting documents. Duties, taxes and government-imposed charges are excluded from our fees unless explicitly stated.
Open Sky Cargo SRL cannot be held liable for failure to perform caused by circumstances beyond our reasonable control, including acts of war, natural disasters, strikes, government restrictions or carrier schedule changes.
Invoices are payable within 14 days of invoice date unless otherwise stated. All amounts are in EUR unless otherwise specified.
These terms are governed by Romanian law. Any disputes shall be submitted to the competent courts in Bucharest, Romania.
